This website, fixmyappliancephoenix.com (the “Site”), is operated by Zellerhaus, LLC, a Texas limited liability company, doing business as Fix My Appliance Phoenix(“we,” “us,” or “our”). By accessing or using the Site, or by calling a phone number listed on it, you agree to these Terms of Use. If you do not agree, do not use the Site.

1. What this service is

Fix My Appliance Phoenix is a referral service. When you call a number on this Site, we connect you with an independent, locally operated appliance repair company that serves your area. We are not an appliance repair company, we do not perform repairs, and the companies you are connected with are not our employees, agents, or contractors. Any service agreement you enter into is solely between you and that company, which sets its own rates, schedules its own work, and bills you directly.

2. No endorsement or warranty of providers

We do not warrant, endorse, or assume responsibility for the work, licensing, insurance, qualifications, pricing, or conduct of any repair company you are connected with. It is your responsibility to verify that a service provider is qualified to perform the work you hire it for. Any dispute about services rendered must be resolved directly with the company that performed them.

3. Calls and recording

Calls placed to numbers on this Site may be recorded or monitored for quality assurance and routing purposes. By placing a call, you consent to such recording where permitted by law. Standard carrier charges may apply.

4. Informational content

Guides, symptom lists, error-code explanations, and similar content on the Site are provided for general information only. They are not professional advice, and we make no promise that following them will diagnose or fix your appliance. Repairs involving electricity, gas, or water carry risk; when in doubt, stop and call a qualified technician. You act on the Site’s content at your own risk.

5. Acceptable use

You agree not to misuse the Site, including by scraping it at disruptive volume, attempting to breach its security, placing fraudulent or harassing calls, or using the Site for any unlawful purpose.

6. Intellectual property

The Site and its content are owned by Zellerhaus, LLC or its licensors. Appliance brand names appear only to identify the equipment you own and do not imply any affiliation with or endorsement by the manufacturer. You may not reproduce or republish Site content without our written permission, other than ordinary personal, non-commercial use.

7. Disclaimer of warranties

THE SITE AND THE REFERRAL SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT A REPAIR COMPANY WILL BE AVAILABLE AT ANY GIVEN TIME.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZELLERHAUS, LLC AND ITS MEMBERS, MANAGERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY DAMAGES ARISING FROM SERVICES PERFORMED BY AN INDEPENDENT REPAIR COMPANY. OUR TOTAL LIABILITY ARISING OUT OF THE SITE OR THE REFERRAL SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100).

9. Indemnification

You agree to indemnify and hold harmless Zellerhaus, LLC from claims arising out of your misuse of the Site or your dealings with any repair company you are connected with.

10. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute arising under these Terms will be brought exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

11. Changes

We may update these Terms from time to time. The effective date above reflects the latest revision, and continued use of the Site after a change constitutes acceptance.
